Popwear respects the intellectual property rights of others and requires that users of our service do the same.
Pursuant to the Digital Millennium Copyright Act (DMCA), Title 17, Section 512 of the United States Code, Popwear will respond expeditiously to claims of copyright infringement committed using the Popwear service that are reported to our Designated Copyright Agent, identified in the section below.
If you are a copyright owner, or are authorized to act on behalf of one, you may report alleged copyright infringements taking place on or through the service by submitting a DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Upon receipt of the Notice as described below, Popwear will take whatever action, in its sole discretion, it deems appropriate. This may include the removal of or disabling of access to the challenged material.
If we remove or disable access to content in response to a Notice of Alleged Infringement, we will make a good faith attempt to contact the user who submitted the material to inform them that it has been removed. This will provide them with the opportunity to submit a counter-notification. We may also forward a complete copy of the original notice to the user or other parties as appropriate.
Submit Your Copyright Infringement Report
Procedure for Reporting Claimed Copyright Infringement
To file a notice of copyright infringement with Popwear, you must provide a written communication to our designated copyright agent that includes substantially the following information:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including information reasonably sufficient to permit us to locate the material (such as the specific URL of the content on the Popwear platform).
- Your contact information, including your mailing address, telephone number, and email address.
- The inclusion of the following two statements within the body of the notification:
- "I hereby state that I have a good faith belief that the disputed use of the copyrighted material or reference or link to such material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
- "I hereby state that the information in this notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
- Your full legal name and a physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Instructions for Reports Concerning Images
To request the removal of all identical copies of an infringing image, please state at the beginning of your notification: "Remove all content that contains the image." Please be advised that Popwear can only process the removal of identical copies of an image. If an image file has been resized, altered, or otherwise modified, we may be unable to locate or remove it.

Important Notice
There may be legal and financial consequences for fraudulent or bad-faith submissions. Before submitting a notification of claimed copyright infringement, please ensure that you have a good faith belief that the reported content is infringing, having considered applicable legal doctrines such as fair use, and that you understand the ramifications of submitting a false claim.
Content Removal Due to Copyright Infringement Reports
If you have received a notification regarding the removal of your content due to a copyright infringement report, this indicates that the copyright owner submitted a complete and valid takedown notice. To request a copy of the information contained in this report, please submit your request via email to [email protected]. Please note that we may redact certain personal contact information for privacy.
Accounts with repeated instances of copyright infringement may be subject to penalties, which can include the suspension of certain privileges.
If you believe your content was removed in error, you may file a counter-notification. Upon our receipt of a valid counter-notification, the content will be reinstated, and the complaint will be removed from your account's record.
Important Notice: The submission of fraudulent or bad-faith counter-notifications carries potential legal and financial consequences. Before filing a counter-notification, you must have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification and understand the repercussions of submitting a false claim.
Procedure for Filing a Counter Notification
In the event that your content is removed as a result of a copyright infringement report, you will receive an email notification containing instructions on how to file a counter notification. A counter notification should only be submitted if you have a good-faith belief that the content was removed or disabled by mistake or misidentification.
Upon receipt of a valid counter notification, we will forward it to the party that submitted the original copyright claim. The information forwarded will include your contact details, which the claimant may use to contact you directly or to pursue further action.
If the claimant does not notify us that they have filed an action seeking a court order or an order from the Copyright Claims Board to prevent the content from being reinstated, we will reinstate the content. This reinstatement process may take up to 14 business days following receipt of your counter notification.
Appeal Copyright Strike
In the event that your content is removed pursuant to a report of copyright infringement, and you are unable or unwilling to submit a counter-notification, you may appeal an associated copyright strike. To do so, you must provide a detailed explanation of the circumstances that you believe justify the removal of the strike. We will review the appeal and take appropriate action.
